any hope clyw may have rests solely on drago daic. that is quite the irony isn't it? until you see that the daic people have filed something, clyw exists only as a fleeting idea.

currently tmobile has won a huge victory and a powerful deterrent to any challenger who must face years of time and tons of money just to get back to a square one jury trial.

I think the court has made egregious errors. The fact that neither tmobile in their latest response nor gilstrap address payne's unconscionable rewriting of the patent language in his markman further suggest or hint at the evidence of error:

preestablished and predetermined do not mean the same thing. for example:

predetermined = maxium theoretical access point coverage

preestablished = real world range in which connection between mobile and access point will be able to occur.

if the patent always implied preestablished=predetermined then there would be no need in the patent for two separate and distinct words to describe the same thing.
