Definition of scam:

noun
1. a confidence game or other fraudulent scheme, especially for making a quick profit; swindle.

Here's the main problem with using this term. For this to be a scam, there would have to be no product and sales. As they have both the product and the sales, it does not fall within the criteria.

Recommendation - find a different word that is actually accurate.
