Einhorn in all of this comes across a little whiny. He's losing the mojo he once had. He crushed Herbalife with a simple question in a conference call and it was amazing to watch a single Wall Street icon wield that much power. I don't think all of this crying "hey judge I'm losing my ass on a trade so make AAPL make it better by giving us money" crap is going to help his future. I don't think a judge should honestly and objectively consider his argument with regard to the better good. Which is always, the company and the technology it is capable of producing always comes first. This whole circus of crap IMO is embarrassing for Einhorn.
