I don't think we need to worry about any particular employee at the CRO. The employees are the agents of the CRO, and as such the CRO is responsible for their actions. At least that is my understanding.

I believe Peregrine needed cooperation from the CRO in the trial review process. I suspect there was some understanding between Peregrine and the CRO that Peregrine would go easy on them in return for their cooperation. This might mean that Peregrine would not sue for an amount in excess of the CRO's liability insurance. Just speculation on my part.
