If Google did in fact pull a fast one on the judge he could unleash his wrath on them and award something >3.5%. I am assuming judges do not like to be embarassed, but I will defer to JJ or Red on that. Fwiw I agree that we will not do any worse than 3.5%. I think most of us feel that way.

I could envision a scenario where the judge screws google on the royalty rate and screws VRNG on the laches and jury miscalculation. That way both sides get screwed in some manner that leaves this open to appeal and that better facilitates a settlement.

If the judge takes his wrath out on Google than I definitely see a settlement coming. Google turned the whole process into a circus and I doubt an appeals court would sympathize with them after lying to a judge.

I could be completely wrong, but it cetainly is interesting to discuss.
