RXPC promised no bankruptcy up to August 31, 2012. After that, all bets are off.

As a condition to the exercise of the Warrants, we agreed that following the date of the May Agreement and through and including 5:00 p.m. (EDT) on August 31, 2012, we will not file in any U.S. Bankruptcy Court a voluntary petition for reorganization under Chapter 11 of Title 11 of the United States Code or seek to liquidate under Chapter 7 of such Code.
