I think Calypso's attorneys make a very good argument for reversal of the R&R. I do believe members of the jury could find infringement if they were given the chance. The non-infringement Summary Judgment should be reversed and denied. It sounded to me like the judge put too much weight on Tmobs witness statements in issuing his findings. I believe Judge Payne's ruling will be reversed upon appeal. The judge became the judge and jury, with too many questions remaining. I don't see this case ending until all appeals are exhausted. We have not seen the end of this case.
