This is no small matter. Your analogy is way off. It is more like death is to a person. If CLYW tried to bring a patent infringement suit, the defendant would ask for a summary judgement citing that Calypso does not exist. Chances are that it would be granted. Right now Calypso has the same legal standing as a dog, i.e., none!
