within a range, anywhere within a range, that should be what calypso controls--once inside a connection should be made if at all possible this seems to be a fight over who is master--quality control vs fcc regulations, on one hand quality control should lose outside range, in range the judge has ruled that quality control wins-- the problem is quality control is an averaged quantity that depends on statistics gathered about some threshold that is within range (if legal), in effect its mapping the boundry before it switches. as long as they are within threshold the log (bit rate error), about 1 in 1000000, maps back to a smooth quality control parameter ratio when inverted; this creates a cutoff that equates to an average distance hence first switch into wifi is distance based likewise last switch out is also distance based so it also infringes. if the call later switches back into cellular when deeper into range then quality control takes on a different meaning and its this meaning that should be in dispute--not the first in nor the last out--it should be crystal clear to the court that the latter two are infringements, the myriad of former scenarios are merely a patch to compensate for an inferior implementation!
