You are absoutely right.

By law, if they receive compensation for a promotion they must disclose it (the compensation information) in their distribution materials.

However, a lot of promoters operate out of countries in Asia and South America where the US SEC is unlikely to prosecute them if they violate the disclosure laws. APS had an office in Singapore for example.

In regards to tracking and timing there is a company (OTC Dynamics) that makes software to do exactly that - track and time stock promotions (from all promoters).
