The first patent application was introduced in 2007 two years before Microsoft's'"remarkably similar" application. Having spoken to patent attorneys and individuals with many approved patents in their name, they tell me that with each passing day at this stage in the process the odds of approval increase. Most patents do not make it this far into the process. Its like going into the 9th inning with a 3 run lead and Mariano Rivera as your closer. Not a 100% guarantee but you have to be giddy about your chances. Furthermore, the fact that MSFT with all their money and lawyers and technology experts filed a "remarkably similar" patent is very encouraging. I love my chances.
