APWR is free to release earnings statements. There is no entity preventing them from doing so. Your post is implying this.

BTW look at ONP. They have been releasing financials during the course of the class action and in fact even distribute a dividend. APWR has chosen to remain dark and has chosen to stop communication to shareholders and the public. Lets keep things in perspective.
