Let me amend my answer cheeps. I think United will win "something"...but it may not be near enough to right the wrong...and to me that's as good as a loss.

I would be interested in a lawyers opinion to know if United does win big if that opens flood gates for other banks who suffered the same (or even worse) handling by regulators?? Would they have recourse because of the United case? Is that in the back of the Judges mind as she considers a ruling?? Should it be?

The Gov't has done a masterful job of demonizing Wall St the past 4 years and especially banks! Could that subconsciously influence her decision in some way? I think it could. If you ask 1,000 Americans if a bank should win a case like this 999 will say 'Oh hell no'! I don't think Judges are immune from public sentiment no matter how impartial they're supposed to be.

It's politically correct on Main St to think Wall St banks are evil to their core and however Uncle Sam can put the screws to them is more than justified.

I don't agree with that but I'm afraid that's the culture we live in 2012.

I want United to win. I don't own shares so its not for monetary gain that I feel that way. I want right and wrong restored in our country. period. The question is is the Judge of the same opinion and does she have the guts to do it?
