Very thoughtful post, however, the assumption that the SEC isn't wrong regarding KMAG or many issues is one that is definitely VERY debatable:

www.judicialwatch.org/blog/2012/11/sec-watchdog-fired-for-reporting-misconduct/
www.judicialwatch.org/blog/2011/08/sec-rewards-investigator-who-botched-madoff-probe/

Some quotes from the above article: 'famously inept federal agency'..'the SEC has made headlines for a variety of shameful transgressions'..'come under fire for wasting nearly $557 million on luxurious office space it will never use and lying to cover up the wrongdoing'..'Then there was the botched investigation of the largest Ponzi scheme in history. The incompetent SEC investigator who missed Bernie Madoff’s illegal, $50 billion Ponzi scheme actually got a cash bonus for his good work. A scathing SEC Inspector General report exposed this atrocity and outlined how the agency failed miserably to catch Madoff, who defrauded investors out of billions and eventually pleaded guilty to 11 felonies.'..'Instead of taking action to remedy the “significant failures” SEC officers and employees tried to “cover-up” and “white wash” the “public relations disasters” '

Then we have the issue of why we haven't heard from Jeff...well, clearly (to me anyway)...there are only 2 possible explanations to answer why :

1) The SEC is right and JR cannot say or PR anything lest he further incriminate himself...if this is the real reason, the naysayers here are right and the stock will eventually fade away.

2) The SEC is wrong....JR has already put out a PR saying the company will "vigorously defend itself" and the company and Jeff will do just that WHEN the attorneys say he can....if this is the real reason, the faithful here are right and the stock will eventually soar.

Doesn't matter what you, I , or anyone believe is the right timing...it is now in the hands of JR and the attorney's and their timing will be THE timing. I hear over and over how dealing with the SEC & FINRA takes many months, even years - well, right now, we are about 2.5 months into this since hearing from the company...does that really justify concern?....IMO, it will again simply be answered by the result here - pro KMAG, it will look like the prudent, thoughtful path...anti KMAG, it will look like avoidance.

I, like you, am also very tired of seeing investors bilked out of $$$$...it's the reason many have left the market - they rightfully, IMO, believe it's a rigged game...many who have invested in KMAG did so because they felt they may have finally found a non-scoundrel type CEO in JR, so there is no question the resolution here will have some small impact on some of us common folks perception of possibilities here in pinky land..I shamelessly admit that I WANT this story to end well just to show that it IS possible to have a real company with honest and forthright leadership - this isn't blind worship as I am well aware that this is pretty much an all or nothing bet (with the odds, though not the facts yet, stacked against)..the biggest reason I'm sticking with JR is his track record - everything he has said or written about has come to pass, (though not always in the timeframes promised)- he has proven again & again his word is gold - and that still means a hellava lot to an old fart like me...in the coming weeks as this is resolved, we all will learn something - right now, we just don't know for sure what.

Best to you JFP4 & all KMAGGERS....I'm betting on JR until I'm shown convincing proof that I should not. Yes, it's a longshot, given the power of government, but I also know that I , for one, will NEVER bow down (unlike a certain leader of ours) and take it without fighting for what is right.. JR is a fighter as well and that's another big reason I'm with him.. $$KMAG...Apologies for the long, drawn out post.

So if the SEC isn't wrong, than what is the issue? I find it hard to believe that such an acclaimed individual as Jeff Reid would continue to remain silent if he had some serious defense in this case. We should have heard something by now, don't you think?
