Everyone's thought of that scenario, your coworker's not breaking any new ground there. But A) creating a new system ain't as easy or quick as your coworker suggests it is, and B) wouldn't you think they'd have done it by now? They knew as well as everybody else they were infringing. The only people that think Google's gonna pull a program outta thin air before they have to start paying are people that don't know what goes into it. They lost the trial for a reason.
