The case of ScanBuy against NEOM was dismissed!! on 10/12/05!! This is great news; their countersuit has been thrown out; and NEOM's case against them, for patent infringement, is PROCEEDING. I'll paste below the text of the Judge's comments. Also note: the future dates scheduled, were also terminated as of 10/12.
Finally, the first page listing the cases and the date filed/opened and closed..and now the ScanBuy case has 10/12 in the date closed column!

ScanBuy v NEOM.
1. Document 15 was filed 10/12; it says "Stipulation and Order of Dismissal Count II and III with prejudice and without prejudice as to Cout IV.
(My Note: "With prejudice" means ScanBuy can't refile this complaint count; "without prejudice" means they can refile the one count..but..there is a good reason, apparently, that it was thrown out now.)
2. The previously hearings/dates that were filed and set upon 9/8 were Oral Argument set for 12/12; reply deadline due 11/22, cross motions deadline due 11/7, and response deadline set for 11 / 7 = all TERMINATED as of 10/12.
