No idea what's going on here, but...

The judge has plenty of leeway as to when he issues his Markman order since the Markman ruling is not final until the jury is instructed...in some trials, the Markman ruling has not been issued until after trial and before jury instructions...

I'm sure the judge would like to avoid a Markman appeal as the majority of patent case appeals hinge on the Markman order...
