From the RJR 10-Q -"On September 26, 2012, RJR Tobacco paid Star $5 million pursuant to a confidential settlement agreement resolving Star I and Star II . RJR Tobacco withdrew its Supreme Court petition in Star I on September 21, 2012, and Star I and Star II were dismissed with prejudice on September 24, 2012."

The agreement resolved the litigation, not the payment of the $5 Million. The $5 Million was paid on September 26 pursuant to the agreement. We do not know what the terms of the Agreement are. For instance, does the Agreement provide for an upfront payment of $5 Million upon execution, with periodic additional payments made thereafter? Ongoing license fees? We do not know. But it has not been stated definitively that the litigation was settled for $5 Million (which, of course, could have been very simply stated if so). The quarterly report is for the period ending September 30, so we do not know what other amounts RAI may have paid to STSI “pursuant to the agreement” after September 30. We could just as easily see another statement in their next 10-Q that they paid $XX Million to Star “pursuant to” the Agreement

Logical conclusion - Star has already received $5 million. Therefore, based on the wording in the 10-Q, we know that "the agreement" is worth AT LEAST $5 million to Star.
