I understand. My, "yet" was actually due to the fact that trial does not seem to be going google's way at the moment.

I agree with you and to follow that up I'm not really sure that Vringo would accept a settlement if they feel they have the upper hand in court. Everybody talks settlement and sure it could happen but come "court room time" there is a different dynamic taking place. Offering a settlment at this point is google's way of saying, oh crap your winning. Vringo would just go for the gold because they already have the lead.
