To weigh in or not....

I’d love to weigh in on whether this case will go to trial or be settled, but I just don’t know enough to hazard a guess. Darn it.

I will say this with some confidence, though. The trial lawyers, especially Plaintiff’s lawyers, have to be eating, sleeping and drinking this case basically night and day. They HAVE to be concentrating on the actual trial of this case.

The officers and directors of Vrng and any counterparts on GOOG’s side may well be working on settlement discussions---and their proposals will of course be forwarded to the appropriate parties---but the trial lawyers themselves have to be devoting almost all their energies on Opening Statements, refining the arguments on a few last-minute things with the court, going over lay and expert witness testimony, working over just how testimony might change in view of recent court-ordered disclosures by GOOG, studying juror backgrounds and strategies for voir dire input, and dozens of other things. If GOOG has low-balled an offer to Vrng and hardened its position regarding it, things will be much easier for the lawyers, because the distraction of a settlement can be put to rest, and they can devote everything to the trial.

I (and many of us) may be wrong, but I think this is an extraordinary chance for a big hit stock-wise, and the deciding factor will occur within a month....And from what we can see, our side SEEMS to have the odds in its favor. I THINK we have a darn good case.

How often does this happen? Not very often in my experience. An exciting time.
