These day to day swings are one in part of today BS rumor on settlement the stock went up like crazy, If we did not have that rumor the stock would not have been that had that swing from $4.50 to $5.50..

I have been involved in settlements before many times, It rarely happens this early in the game, Both parties most likely thru feelers out there to gage one another. The good thing is trail is next week which puts pressure on settlement.
