rj2: First of all let me say this, "in tact" is spelled "intact". I only mention it because you've done it a few times recently and I know it's driving Sleepin_Easy crazy (he does watch the board). 
Now, by "off the hook" I only mean that he needs to hold to his promise, relayed via Kelly, that he would update shareholders regarding the decision to forgo filing the 10K (and maybe the 10Q?).
And I don't know if it was your wording or his, but it's not accurate to call a project "definite" if there isn't even a deposit yet.
