I see on other boards that they don't understand that amended portions of patents go into effect AFTER the re-exam, and any alleged infringement of such sections BEFORE re-exam are not able to be litigated regarding infringement.

That is the reason Fred used the language "future infringers" in the filing regarding 774 and carefully avoided any mention one way or the other re the latest re-exam. Oh what a tangled wed they weave in their efforts to be artful.

Between the Markman and the re-exams the patents are less than half-strength, and evidently at full strength they were not much considering the steadily declining "settlements" and, accordingly, declining stck price.
