No, the P.R. is intentionally misleading. The company is inferring something they do not have. This gives them no enforcement rights for anything whatsoever about "Baristas".

Let me be clear: My beef is not with the granting of this service mark. My beef is with the blatant mis-information contained in the P.R.

They have not been granted a trademark. It's a service mark consisting entirely of the image of "Miss Information". There are no literal elements to this service mark.

Mark InformationMark Literal Elements: None
Standard Character Claim: No
Mark Drawing Type: 2 - AN ILLUSTRATION DRAWING WITHOUT ANY WORDS(S)/ LETTER(S)/NUMBER(S)
Description of Mark: The mark consists of the head and shoulders of a woman wearing a black beret having long black hair, red lips, black eyes and long black eyelashes. The color white appears in the face and shoulders of the woman. But for the white appearing in the face and shoulders of the woman, the color white appearing in the mark represents background or transparent areas and is not part of the mark.
Color Drawing: Yes
Color(s) Claimed: The color(s) red, black, and white is/are claimed as a feature of the mark.

It's not whether you're right or wrong that's important, but how much money you make when you're right and how much you lose when you're wrong.
