Here is where the Law360 reporter misinterpreted the Complaint:

Paragraph 6.: "Bavituximab is currently being evaluated in three randomized Phase II clinical trials for non-small cell lung cancer and pancreatic cancer."

Paragraph 7.: "Among the trials is a randomized, double-blinded, placebo-controlled Phase II trial evaluating Bavituximab in 121 patients."

Paragraph 8.: "In connection with this trial, Peregrine had entered into a written Master Services Agreement ('MSA') with Defendant CSM in March 2010."

He simply failed to distinguish between "randomized Phase II clinical trials" and "randomized, double-blinded, placebo-controlled Phase II trial" but lumped them all together. This is what happened IMO.
