See my previous post. Motion to expedite, dismiss etc has to do with Def attys trying to persuade the court to require VRNG to file a briefing sooner than is required per scheduling agreement. Def is trying to get AOL and other dismissed b/c majority of damages sought are from GOOG independently. It is simply a strategic move. The same atty Noonan? sp. is representing all D's.

It seems that D is trying to force this issue because we are getting so close to trial. If the court does not grant the order, then essentially this issue is still pending after last pretrial conference.

Bottom line: defendant attorney's are trying to limit liability. If AOL and other are still Defendants the settlement for VRNG to agree will be higher. i.e. more pockets to pull money/damages from.
