You are right in that things can happen beyond anyone's control but that does not exclude from failure. If Scott said we are doing a JV and we will update the public as soon as possible that is one thing. If he says we will update in September and September comes and goes that is failing to live up to what you say.

The spin out is an exact example. Scott has not failed to do the spin out till the company is dead. But he said January 2 times and failed there.

I would have nothing bad to say if Scott would not say something without following through. I believe he has every intention of what he says but he should not say it until he can not be wrong. If that means waiting to announce a JV till it is a done deal and we dont get the hype run so be it. Saying it and failing will lose investors fast.
