pcrutch, all patents that are subject to regulatory delays (eg: FDA) can be extended at the end of their 20 Year term as by USPTO regulation. This extension is not arbitrary but granted.

The period by which they are extended is calculated at that time because at that point the final FDA approval date is known.

Once the first Bavi launches (presumably Lung Cancer), all further Bavi application, even if launched a few years later, will not benefit form a full 17 to 20 years patent protection anymore.

So for now, since the mentioned event still has to occur, probably in 2014 at the earliest given the PIII start somewhere mid next year (2013,) the patents will last at least till 2030-31.

However, in your case, since you have not much believe in Bavi, the patent protection coming to an end is a non issue. What's the point of a patent protection of something that's not working and of which you claimed that it is criminal to give to patients.

Even if Peregrine would have the patent protection eternally I geuss it wouldn't be a big issue from where you stand, would it!
