Does Domark even have the rights to the SolaCAse for the iPhone?

As per the agreement that was filed with the SEC (Form 8-K) on 2/29/2012:

Paragraph 2.

c. XTNG Grants DOMK a first right of refusal for the exclusive worldwide
license for XTNG's solar charging case for iPhone (SolaCase) under terms
substantially identical to those described herein for the SolaPad. DOMK may
exercise its right of first refusal at any time prior to June 30, 2012. DOMK may
exercise its right of first refusal by providing written notice to XTNG, by
electronic communication and US Mail.


Domark's SEC filings don't appear to confirm that they exercised the right of first refusal by June 30, 2012. Oops!!

Now their misleading Press Releases claiming that they are positioned to take advantage of the soon to be released Apple iPhone 5.

Oh, as far as Domark's "Revolutionary" Solapad claims, they forgot to mention that a recent study by the Electric Power Research Institute determined that the average cost to charge an iPad is just $1.36 per year: http://www.usatoday.com/tech/news/story/2012-06-21/ipad-electricity/55752180/1 So, if you buy a Solapad for $149.99 (plus shipping), you'll break even in about 110 years.

Yep, revolutionary all right!!!
