here's my take...

NOL's are not prermanent. they can expire and have to be written off. at year end, auditor opinion comes into play and the year end adjustments may include recapturing previously expired NOL's based on changing conditions. the recaptured NOL then becomes income.

tax laws are always changing so if this scenario is anything close, i wouldn't be surprised.
