That is an absurd premise. The author is saying because Vringo didn't give google a start date how farback to look they can throw anything in now. Vringo has amazing lawyers, of course if not giving the other side a start date for prior art search opens you up to this move google is using....of course vringo lawyers would have given a date. No way that is what is happening here.
