Stealing an idea is horrible unfortunately hard to prove and no protection until a patent is issued. However stealth mode isn't really needed as a patent pending if it eventually is issued gives the patent owner rights to sue the thief even if the product was made during the patent pending period.

So your scenario doesn't illustrate any reason for a stealth patent pending.

There has to other reasons for the stealth patent filing. I have thoughts but I have to go to work so ,aybe later.
