You are correct. I addressed the subject as well as others. (That's OK on a message board, right?) Until and if the encryption patent is granted then it doesn't really matter when the protected period ends.

And if the patent is granted and has no teeth, then it doesn't matter anyway.

Plus, I think it's important to remind shareholders that the window for any 774 litigation is closing, the markman makes such litigation dubious at best, and the re-exam will only allow litigation for "future" damages - as reiterated by EDIG. Do you agree?
