But we know it's not true that it contains fundamental, essential technology, we know flash/RAM is now a problem, and we know the US courts have killed the patent as it exists and the USPTO exposed the weaknesses.

We also know that Flash-R has steadily eroded the PPS and there is little chance DM will continue with the litigation.
