Not necessarily agreed..I'm just making an emphasis that it is your logic and that is only one that you have so far. I have not seen or read that you consider the other sides and weigh which one is better. Think about that it can be also considered equity or just a hybrid and some exempttions can be applied because you have to consider both. Did you ever think of the possibility of legal actions from the holders since they can also make a fair debate that they bought the stocks as a hybrid of debt and equity?
