What needs to be confirmed, IMO, is who "they" are. BBDA doesn't own the product trademarks, they are just a "developer\marketer\manufacturer." The CEO and COO own the product trademarks in a private corp of which BBDA claims "30% equity."

Would a vendor's contract typically be signed with the developer/marketer/manufacturer or with the company that actually owns the product?
