In many civil fraud cases the defendant upon loosing pays ALL legal expenses of both parties.

Howard could do something right now if he gave a rats ass about anyone but himself.

As you so rightly mention what he is banking on is time to pass, the dust settle and restart a few PR lies to get a whole new crop of unsuspecting investors. He is counting on everybody going quitely in the night and leave message board alone.

Right now ,this very time HOWARD has the ability with all the shares he owns and no telling what sidekicks Watson owns to do a dividend share program to current shareholders on a 1 to 1 or 2 to 1 basis at current PPS. Its done thousands of times by companies that have been unable to perform and investors loosing a ton of money but still waiting for PHAR coming out of the comma.
WOULD NOT HURT HIM AT ALL, AND THIS IS A GESTURE THAT MIGHT CHANGE THE TONE OF THE BOARD IN SOME WAY.

At least those still holding shares can get average way down or use those shares to try and bump share price through some form of trading.
