I agree "the receiver can"...

But, "can" and "is" are different things, including in the context "Thus all the trashing about in TX courts is vacated."

It can be... it may well be that it will be... but, it hasn't been yet, in a way that makes "is" the proper word ?

It remains to be seen whether the benefit available from intending failure will be allowed to provide the benefit intended.
