You cannot sue the BOD you have to sue the company that is the point of a company incorporating. Under rare circumstances you can pierce the Corporate veil & sue the BOD or employees separately but that is a real reach.

I already offered my thought on the suit I personally love lawsuits I can file myself & file motion after motion it cost them money for their lawyers to respond. Sometimes you can win even by losing if you are good enough & they want to be left alone but the BK thing that is a game changer for me. Need permission from the court to sue.
