Lawsuit in the making, I received this as an update to the filing of the lawsuit against Luxon








Gentlemen. One of our group, -------------- of Billings, stepped up and
advanced retainers (Monday past) to our now two legal firms, Harttrinen
of Denver and newly engaged large firm Gordon Silver, Reno office, Will
Hart and Justin Bustos respectively, to further the action against the
Luxons.

Counsel will draw and file the Complaint. Not sure who all will be
Plaintiff but I have been requested by counsel to be one and will be.
The number of Plaintiffs will be kept to a minimum to keep costs in
line. Ideally, additional Plaintiffs could be from the Tahoe-Reno area
to minimize travel time and costs. I will follow up on that with counsel
once the Complaint is drafted. Once filed and served, the Luxons will
have 21 days to respond. I will circulate a copy of the filed
Complaint. As outlined to you in earlier correspondence from Bustos we
will need additional funds pretrial. I will advise on this after filing.

Luxons' window of opportunity to step aside gracefully is closing and
some of you may want to again convey that to Bill (I know that some of
you have very recently done so verbally and by email). He seems to have
insulated himself from reality.

Not aware of any developments on the business side other than what I
conveyed earlier to our action group, but that is as expected. Luxon
appears to continue to sell stock at any price and unfortunately nothing
we can do about the market until he is out.

As I have sent this update to a broader number of persons and
shareholders than just those of our action group I have used Bcc.
