Could SMKY trademarks just possibly not be rolled into Smoky Market Foods because of the unique design of Smoky Market Foods itself located clearly on the website?
I would imagine if each Regional Operating Companies held a share in the proprietary information it could pose a potential of all kinds of litigation.
It costs a minimum of non-borrowed cash of $500k to get into a McDonald's franchise. And even then, all the trademarks are owned by McDonald's themselves and not the franchise owner/operator. I don't think the lack of ownership of proprietary information has hurt those franchises much. If SMKY achieves the necessary funding to move forward, it seems they have followed a rather profitable business model.
