You're wrong. The settling ponds are a MAJOR part of the process system and are one of the only things that NDEP cares about. Water usage and reintroduction of process fluid to the water table is critical and extremely regulated in Nevada (and just about anywhere else in the US). Why do you think they were so critical about the ponds in the first place? The ponds are on a strict monitoring program including monitoring wells with monthly independent laboratory analysis submitted to NDEP, if the monitoring were to show high levels of contaminants (I already explained to you that dirt, silt, mud, clay, sand, etc... are contaminants) NDEP would proceed with enforcement actions which may include shutting BRCM down, from what I can tell they have not.
