Bordynuik still faces disgorgement, a derivative lawsuit so shareholders can get their money that was, according to the SEC, fraudulently obtained, not to mention a class action lawsuit.

Whether or not Bordynuik is allowed to retain this position within the company, is up to the SEC. Anyone claiming that Bordynuik willfully let go control of his "baby" are fooling themselves.
