Not if the company in general has an MM buying back shares into the treasury and reducing the float. This way insiders can see insider trading like gains for the shares they already own without risk of insider trading. As long as insiders aren't buying shares themselves it's not insider trading.

It is relatively easy for insiders to capture insider-trading like gains through the use of "open market repurchases." Such transactions are legal and generally encouraged by regulators through safeharbours against insider trading liability
