I think it was about the wording, not the entire content. The mark is not registered and has not been assigned. It is in 1B intent to use status post opposition period. The PR may have given some the impression that it is an assigned mark 1A. There is a difference but BRAV is still covered through the USPTO for overlap if someone tried to file a resembling application.
