I think your view is unduly fearful of litigation. After all, even with perfect compliance Truvada does not guarantee that a person will not get infected, it just reduces the chances of an infection.
Understood—but I still expect a bevy of lawsuits when people end up getting infected. They will claim that the warnings about possible infection were given short shrift in an attempt to boost sales.
However, this plaintiffs’ argument won’t gain much traction with judges and juries if GILD is not promoting Truvada for prevention. In that case, prospective plaintiffs might decide to sue their doctors instead—or drop the lawsuit idea entirely.
