The problem before was that the packaging of non-NSF compliant products were marked with the NSF logo.... which IS a violation of the NSF rules. I am surprised that this has not been addressed by them yet if MSLP still has this on the packaging.
IMO, it does present a small liability factor. Also, it presents the possibility that NSF could take the rating away if they don't meet NSF criteria.
That being said.... NSF has been aware of this for months and we are still NSF certified. On my list of concerns.... this ranks down with the 400,000 lawsuit.
