There's no requirement to post financials on a penny stock. You have to post them in order to be listed on an exchange such as AMEX. I would think with NASDAQ requirements being 1$ and AMEX being 2$ that those would be the target exchanges to be filed with. All financials would have to be in order for stockholders and the exchange to see.
