I wanted to post a few thoughts to do with Mark Dyne and Brilliant Digital.

Brilliant Digital
During fiscal 2002, we shifted our emphasis from our Internet
advertising and b3d toolset business to our Altnet peer-to-peer business.(KAZAA) This shift in emphasis
occurred gradually over the course of fiscal 2002, and has come about primarily due to our
limited financial resources, which have been unable to support both businesses. Until we have
sufficient resources to support both businesses, we have indefinitely suspended substantially
all of our Internet advertising and b3d toolset operations and intend to focus substantially
all of our limited financial resources and efforts to grow the Altnet business. We intend to resume
efforts once cash flow improves.

In August of 2002 they contracted with Europlay- Dyne's company.

Dear Rob:

We are writing this letter to confirm our understanding that Europlay
Capital Advisors, LLC ("ECA") has been retained for a period of 12 months from
the date this letter (the "LETTER AGREEMENT") is accepted by you, by Brilliant
Digital Entertainment, Inc. and its subsidiaries, and affiliates (collectively,
"BDE" or the "COMPANY") to provide non-exclusive consulting services to the
Company which may include (a) advising the BDE business development team,
providing strategic financial, marketing and managerial advice, introducing
corporate alliance partners, for the primary purpose of promoting, marketing,
and exploiting the Company's private peer-to-peer network currently known as
"Altnet"; and (b) advising the BDE business development team in connection with
the Company's (1) Brilliant Banner ad strategy, and (2) b3d software authoring
tools known as b3d Studio and Studio Pro.

Now we also know that Dyne and Burmeister of Brilliant Digital are cousins so this connection is somewhat expected. We also know as pointed by Drwright that Dyne is now 52% owner of Brilliant Digital.

Also looking at Fong's last company- Orchard- This company was taken private by Dimensional Associates who also had a member on the ORCD Board of Directors...as does Brilliant Digital with Atrinsic.

My thoughts- It is quite possible that Brilliant Digital is trying to re-enter the internet advertising field and doing so by taking Atrinsic private. This would explain Mark Dyne pulling the strings on the BOD and wanting the "dark period" as not to increase the PPS. I don't think that we are going to see a larger buyer i.e. Google/Microsoft due to these facts.
