SpyderLynk Granted Patent, Slapped With Suit

About the same time SpyderLynk, creator of the SnapTag 2D mobile barcode solution, announced receipt of U.S. Patent No. 8,094,870 titled “Encoding and Decoding Data in an Image,” the company was hit with a patent lawsuit by competitor NeoMedia Technologies.

Nicole Skogg, SpyderLynk founder and CEO, said in a statement today that by securing the U.S. patent for SnapTag, the solution is now officially recognized "as a key differentiator in the marketplace." Skogg added that SpyderLynk would be diligent in defending its technology.

Unlike with the QR code, SpyderLynk's SnapTag technology allows marketers to fully brand SnapTags with logos and/or meaningful icons versus the Rorschach-looking black box QR code that must be scanned with an app to begin a dialogue.

Meanwhile, NeoMedia yesterday filed a patent suit in the District Court for the District of Colorado that asserts infringement of two NeoMedia patents related to its mobile barcode resolution technology and specifically SpyderLynk's SnapTag solution.

Specifically, the complaints assert infringement of the following patents: U.S. Patent Nos. 6,199,048 and 8,131,597.

The lawsuit seeks to enjoin SpyderLynk from using NeoMedia’s patented technology and to recover damages caused by the infringement.

David Berten, a partner with Global IP Law Group and NeoMedia’s legal counsel, said in a statement that NeoMedia’s patent portfolio covers a broad spectrum of barcode resolution techniques and NeoMedia has, over the years, successfully negotiated multiple license agreements with some of the top players in the mobile barcode market.

NeoMedia claims that SpyderLynk has willfully infringed upon patents related to the scanning of barcodes using the camera on a smartphone.

When reached for comment, SpyderLynk said it had just received the filing and are reviewing it with legal counsel and have no further comment at this time.
